Terms of Service
These Terms of Service set out your rights and obligations, usage rules, and liability boundaries when you use Botflare - Bot Creator and related capabilities.
01 Acceptance
1.1 Formation and counterparties
- These Terms of Service ("Terms") are concluded between Sichuan Miaosuan Technology Co., Ltd. ("we," "us," or "our") and anyone who accesses, downloads, registers for, or uses our websites, Bots, APIs, and related offerings ("you") relating to Botflare - Bot Creator. They bind both parties legally.
- "You" may be an individual or an authorised representative administering an organisation (company, agency, team). You represent you have authority to bind that organisation; members' use is within that scope and their organisation remains responsible as applicable law requires.
1.2 Agreement to the Terms
- By checking consent boxes, clicking register, sign-in, continue, creating an account, calling APIs, or using the services, you confirm you read, understand, and agree to these Terms together with the Privacy Policy and Refund and Cancellation Policy.
- If you disagree with material provisions, do not register or use the services; you may generally review public marketing or informational pages only as law allows without breaching these Terms.
1.3 Scope and versions
- Product scope follows current website, in-product, and documentation descriptions and may evolve. Beta, preview, or experimental features may differ in stability, support, or billing; we label them where practical.
1.4 Changes
- We may update these Terms for law, compliance, product, or business reasons. Updated Terms post with a revised "Last updated" indicator.
- Material adverse changes receive reasonable notice (for example in-app, email, or site notices) when required or appropriate. When consent is legally required, changes take effect only after you agree.
- Unless law states otherwise, continued use after the effective date constitutes acceptance; if you disagree, stop using the services and close your account or request deletion as applicable law and the Privacy Policy allow.
1.5 Severability and survival
- Invalid provisions are severed or reinterpreted minimally; remaining provisions stay effective. Natural survival clauses (intellectual property, disclaimers, liability limits, dispute resolution) continue after termination.
1.6 Contact

- Questions about the Privacy Policy or Refund and Cancellation Policy may use the same channel or other published contact paths.
02 Accounts and eligibility
2.1 Eligibility and accurate data
- You represent you meet minimum age and capacity requirements; minors need guardian approval (see Privacy Policy "Children's privacy").
- Provide accurate registration data (for example email, as fields require). Inaccurate or misleading data may lead to suspension or termination with opportunity to correct where reasonable.
- Multiple accounts may be allowed when lawful; we may consolidate or close accounts used to evade policies or fair-use expectations.
2.2 Non-transferability
- Accounts and credentials are personal or organisation-scoped; you may not sell, lease, lend, gift, or host accounts for others to circumvent these Terms or platform rules without our written approval.
2.3 Security
- You are responsible for activity under your account unless directly caused by our gross negligence as law defines. Use strong passwords, enable multi-factor authentication where offered, protect API keys, Bot tokens, webhook secrets, and rotate high-risk credentials with least privilege.
- Report suspected compromise promptly; we cooperate with reasonable security steps but are not liable for losses caused by delayed user action to the extent permitted by law.
2.4 Verification
- We may request identity or business documentation for fraud prevention, payments compliance, or legal duties. Failure to cooperate without good cause may lead to feature restrictions.
2.5 Suspension preview
- Violations, risk, or legal demands may trigger limits described under "Termination"; voluntary closure follows in-product flows; data handling references the Privacy Policy.
03 Services
3.1 Product scope
- Core offering: Botflare - Bot Creator (multi-platform Bot creation, orchestration, and related capabilities) plus accounts, billing, web or other clients as released, APIs, documentation, and support. New modules may launch with updated Terms or addenda.
- Features depend on third-party platforms (Telegram, Discord, etc.); we do not control them and are not liable for their downtime, policy changes, or enforcement insofar as law permits (see "Third-party services").
3.2 Availability
- Except express SLAs in a separate contract, services are "as is" and "as available." Maintenance, incidents, networks, force majeure, third parties, or business decisions may interrupt service. Planned windows may be announced; urgent mitigations may occur without advance notice but we seek reasonable restoration.
3.3 Changes to features
- We may ship updates (including automatic client updates) or modify, merge, or retire features. Material behaviour changes will be described reasonably in-product or documentation; consent is obtained when legally required. Beta features may change or end without liability beyond mandatory law.
3.4 Fair use and guardrails
- We may rate-limit traffic, concurrency, or hosting counts per subscription tier to protect infrastructure and users. Excessive or harmful use may require upgrades, throttles, or negotiated commercial terms.
3.5 Territory and compliance
- Sanctions, export controls, or local prohibitions may restrict certain regions; you must ensure your use is lawful where you operate.
3.6 Your configurations
- Message flows, automations, and integrations you build remain your responsibility legally; we supply tools, not business, regulatory, or end-user outcome guarantees except where mandatory law applies.
04 Permitted and prohibited conduct
4.1 Lawful use
- Comply with applicable laws, platform policies, and community standards for each connected service. Obtain required consents for end-user data.
4.2 Prohibited conduct (illustrative, not exhaustive)
- Illegal activity, fraud, exploitation, content that unlawfully harms or endangers minors (as defined by applicable law), extreme violence incitement, hate speech, IP theft, malware, bypassing security or billing controls, reverse engineering except where law forbids such restrictions, resale or white-labelling competitive hosting without permission, spam, manipulative Bot behaviour, or unlawful surveillance absent transparency and human oversight where mandated.
4.3 Platform-specific duties
- Obey each Bot platform's messaging, media, mention, and automation policies; enforcement actions by platforms are your risk. Do not impersonate, phish, or harvest credentials; follow the Privacy Policy and platform data rules.
4.4 Enforcement
- We may warn, remove content, throttle features, adjust hosting entitlements, suspend or terminate accounts, cooperate with authorities, or pursue legal remedies as appropriate. Emergency mitigations may precede detailed notice when law allows. Appeals may be submitted through published support channels for reasonable review.
4.5 Monitoring disclaimer
- We are not obligated to pre-screen everything but may scan, sample, or respond for legal, security, or policy reasons. You indemnify us for third-party claims arising from your misuse to the extent permitted by law and subject to the limitation of liability section.
05 User content and licence
5.1 Definition
- "User Content" includes configurations, scripts, templates, key metadata (not raw secrets we are not engineered to possess), routed messages or media processed by Botflare - Bot Creator, logs, uploads, attachments, forum posts—everything you furnish or transmit.
- Third-party personal data inside User Content requires your lawful justification and alignment with our Privacy Policy.
5.2 Ownership
- You retain rights you lawfully hold; routing through our services does not alter third-party platforms' ownership of their content.
5.3 Licence to us
- You grant a worldwide, non-exclusive, royalty-free licence (sublicensable only to subprocessors providing the services) to host, process, cache, transmit, display in your workspace, back up, convert formats, secure, and disclose when law or these Terms require. Aggregated or de-identified analytics may improve the product; expanded model training or secondary uses will follow legal requirements and product notices.
5.4 Your warranties
- You have rights or permissions for User Content; it is lawful; it does not violate others' rights or contain malware for prohibited purposes.
5.5 Our IP
- Software, branding, documentation, and trade secrets remain ours or our licensors', subject to open-source licences where applicable.
5.6 Feedback
- Suggestions you provide may be used freely without obligation or compensation unless we agree otherwise in writing or law forbids release.
5.7 Complaints and takedowns
- Report suspected infringement via team@botflare.ai or future published intake forms including proof of authority. We investigate per applicable timelines; false complaints may incur liability you bear toward affected parties per law.
06 Fees and billing
6.1 Plans and quotes
- Features and entitlements referenced on pricing or checkout prevail.
6.2 Renewals
- Subscriptions renew each cycle unless cancelled through in-product tooling before deadlines or sooner if law demands. Renewal charges use stored payment instruments subject to issuer approval.
- Receipts and tax documents may be issued under local rules by Merchant of Record or payment partners appearing on bank statements according to disclosures at checkout.
6.3 Taxes
- Prices may exclude VAT, GST, sales, withholding or similar charges; collectible taxes appear at checkout consistent with disclosures; you handle self-assessed taxes where assigned to you under law.
6.4 Price updates
- We may adjust fees; continued use after notice (or statutory effective date) constitutes acceptance absent cancellation before the effective price change except where mandatory consumer protections provide otherwise.
6.5 Non-payment
- Failed charges or unpaid balances—after reminders and grace windows where fair—may downgrade entitlements or pause features until cured. Backup your data; we are not liable for access loss due to unpaid accounts as law permits.
6.6 Processors and statements
- Third-party gateways process card or wallet data per their contracts; we typically tokenise or mask card data per integration design. You authorise charges you initiate and must notify us of unauthorised use through proper channels (including your bank's dispute process when appropriate).
6.7 FX
- Displayed currency governs; foreign exchange or cross-border fees from banks are between you and those institutions.
6.8 Merchant of Record
- Certain purchases may be sold by a Merchant of Record partner that collects payment, remits indirect taxes, and appears on card statements as disclosed at purchase. We deliver the Botflare - Bot Creator subscription or digital product and support as described in the Refund and Cancellation Policy. Unless law requires or a separate written agreement states otherwise, you will not pay twice for the same checkout nor demand duplicate tax invoices that the Merchant of Record already lawfully issued for that consumer transaction.
- You must also accept that partner's buyer terms and privacy notice for the payment leg of the transaction.
6.9 Refunds and cancellation
- Cancellation rights, refund windows, trials, and chargeback cooperation are detailed in the Refund and Cancellation Policy; it controls over conflicting summaries for refund topics. If buyer terms from the checkout partner differ, tax and payment mechanics follow the checkout partner where required by law or contract, while product usage terms follow these Terms and the Refund and Cancellation Policy except where mandatory consumer law says otherwise.
07 Refunds and cancellation (summary)
7.1 Full policy
- The Refund and Cancellation Policy governs subscription cancellation steps, refund eligibility, timelines, and relationships with third-party checkout partners.
7.2 End of subscription
- After expiry or cancellation, accounts may revert to free or limited tiers; export data beforehand; retention and deletion follow the Privacy Policy and in-product notices.
08 Third-party services
8.1 Independence
- Integrations (platforms, payments, analytics, identity) are not our agents; we do not warrant their accuracy, availability, or privacy practices.
8.2 Your compliance
- You follow each provider's terms; disputes with them are primarily between you and that provider though we may assist with reasonable information where required.
8.3 Links
- Links or connectors are convenience only; we do not endorse third-party content.
8.4 Third-party claims
- Assert claims against the responsible third party; we are not a party to those commercial disagreements except as law compels cooperation.
09 Disclaimer
9.1 As-is / as-available
- To the fullest extent permitted by law, services (principally Botflare - Bot Creator and ancillary tools) are provided without warranties of merchantability, fitness, non-infringement, uninterrupted operation, error-free performance, or freedom from harmful code.
9.2 Dependencies
- We do not guarantee compatibility with every third-party stack; issues caused by third parties or your environment are not our responsibility beyond what law mandates.
9.3 AI or automation
- Any AI-assisted configuration is informational, not professional advice (legal, medical, financial, etc.); you maintain human review and compliance responsibility.
9.4 Consumer protections
- Non-waivable statutory rights remain; disclaimers apply only to the minimum extent inconsistent law allows.
10 Limitation of liability
10.1 Consequential damages
- To the maximum extent permitted by law, we and our affiliates, directors, employees, and vendors are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, goodwill, data, or business interruption) even if advised of the possibility.
10.2 Cap
- Aggregate liability for any claim related to these Terms or the services is limited to fees you actually paid to us for the specific service giving rise to the claim during the twelve (12) months before the event, or zero if no fees were paid—except where law prohibits such caps.
10.3 Non-excludable items
- Liability for fraud, wilful misconduct, gross negligence, or death or personal injury that cannot be limited under applicable law is not excluded.
10.4 Indemnity
- You will defend and indemnify us against third-party claims arising from your breach, User Content, or unlawful use, including reasonable legal fees, except where solely caused by our wilful misconduct as law defines.
11 Termination
11.1 By you
- Stop using the services and close your account per in-product steps; export data first; residual retention follows the Privacy Policy.
11.2 By us
- We may suspend or terminate for breach, risk, law enforcement needs, chronic non-payment, or strategic product decisions. Free or beta offerings may end with reasonable notice; paid periods generally run through prepaid cycles or receive refunds as the Refund and Cancellation Policy requires.
11.3 Effects
- Rights to access end; surviving provisions remain. We may delete stored configurations; lack of backup is your risk within legal limits.
12 Dispute resolution
12.1 Governing law
- Interpretation and performance follow the laws applicable to you without universal choice-of-law imposition that would strip non-waivable consumer protections in your home jurisdiction.
12.2 Negotiation
- Parties attempt good-faith resolution first via team@botflare.ai or other published contacts.
12.3 Courts
- If informal resolution fails, either party may bring claims in courts with jurisdiction under applicable law.
12.4 Electronic notice
- We may deliver notices by email, website postings, or in-product messages unless a particular law requires another channel.
